The Law Ministry on Thursday (today) sent the summary regarding the reopening of the Swiss cases against President Asif Ali Zardari to Prime Minister Yousuf Raza Gilani in which it is stated that according to Article 248 of the Constitution of Pakistan, 1973, no incumbent president can be prosecuted in and abroad, as he has the immunity under Article 248. The Supreme Court will take up this case tomorrow on 24-9-2010 .

 In this context, the Communist Party of Pakistan (CPP) on 14-4-2010 challenges and seeks interpretation of Article 248 concerning the boundaries and conditions of Immunity to President of Pakistan from the Supreme Court of Pakistan and this petition is still pending for decision by Supreme Court. In our party point of view, the President does not have any immunity in and abroad under Article 248 on corruption charges.

 Supreme Court of Pakistan is, therefore, now requested to take our petition of Article 248 for interpretation on priority basis.
